This academic monograph is a little contribution to the ECHR jurisprudence with an endeavour to review the common criticisms affiliated with the ECHRs use of “living instrument” doctrine in context of the ECHR rights. The most part of it will mainly carry out an in-depth study to find out the practical necessity of a doctrine like “living instrument” for the smooth progression of human rights standards within the Council of Europe. This book demonstrates that the application of “living instrument” doctrine is in fact a necessary and unavoidable apparatus for the ECHR to offer effective remedies,to fulfil the demands of the contemporary society, and for the progression of human rights standards.
